Right to Collective Bargaining

Every member has the right to be represented in collective bargaining negotiations. Your interests, concerns, and priorities are brought to the table and advocated for by our experienced bargaining committee.

Right to a Clean Clam Workplace

No member should ever be forced to accept or work with dirty clams. Our union fights to ensure that every workplace and environment meets the clean clam standards established through our agreements.

Right to File Grievances

If your rights are violated, you have the right to file a formal grievance. The union provides a structured grievance procedure with representation at every step, from initial filing to final resolution.

Right to Report Violations

Members can report clean clam standard violations without fear of retaliation. The union provides whistleblower protections and will investigate all reports thoroughly and confidentially.

The Grievance Process

Our structured grievance process ensures that every violation is taken seriously and every member receives fair representation. Here is how it works, step by step.

Report to Your Steward

Contact your assigned steward or Chief Steward Red O'Brien. Describe the issue in detail — what happened, when, where, and any evidence you have.

Investigation

Your steward investigates the report, gathers evidence, interviews witnesses, and documents everything. This typically takes 3–5 business days.

Informal Resolution

The steward attempts to resolve the issue informally with the responsible party. Many issues are resolved at this stage through direct communication.

Formal Grievance Filing

If informal resolution fails, a formal written grievance is filed. The grievance is reviewed by the bargaining committee and officially submitted.

Bargaining Committee Review

The bargaining committee meets with the opposing party to negotiate a resolution. The full weight of the union is behind you at this stage.

Arbitration (if needed)

If no resolution is reached, the matter may proceed to binding arbitration with a neutral third-party arbitrator. The union covers all arbitration costs.

What To Do If Your Rights Are Violated

DO:

  • Document everything — dates, times, details, witnesses
  • Contact your steward immediately
  • Preserve any physical evidence
  • Follow the formal grievance procedure
  • Attend all meetings related to your case

DON'T:

  • Don't accept or handle a dirty clam under any circumstances
  • Don't try to resolve it alone — the union is here for you
  • Don't retaliate against anyone involved
  • Don't discuss the case publicly without union guidance
  • Don't sign any documents without union review
